Airspace NZ Limited, trading as ærspace, NZBN 9429053826763 ("ærspace", "we", "us") connects people and organisations looking for spaces, venues and facilities (Guests) with owners or operators of spaces available for hire (Hosts).

This Privacy Policy explains how we collect, use, store and disclose personal information. We are committed to protecting personal information and complying with the Privacy Act 2020.

2. What is personal information?

Personal information is information about an identifiable individual. This may include information such as:

  • contact details;
  • organisation details;
  • booking information;
  • communications with us;

  • information provided during use of our platform.

3.1 Information from Hosts

When a Host registers with ærspace, we may collect:

  • legal and trading name;
  • contact details;
  • business information;
  • venue details;
  • venue photographs and descriptions;
  • availability;
  • pricing information;
  • licensing information;
  • insurance information;
  • compliance information; and
  • communications with ærspace.

3.2 Information from Guests

When a Guest uses the platform, we may collect:

  • name;
  • contact details;
  • organisation details;
  • booking enquiries;
  • booking details;
  • communications with Hosts; and
  • feedback or reviews.

3.3 Information collected automatically

When you use our website, we may collect technical information such as:

  • IP address;
  • browser type;
  • device information;
  • website usage information; and
  • cookies or similar technologies.

4. How we collect information

We may collect personal information:

  • directly from you;
  • when you create an account;
  • when you submit a booking enquiry;
  • when you communicate with us;
  • when you communicate through the platform;
  • from information provided by Hosts or Guests; and
  • through website technologies.

Where possible, we collect information directly from the person concerned.

5. Collection of information from third parties (IPP3A)

5.1 When this applies

Sometimes we collect personal information about an individual from someone other than that individual — for example, where a Host provides us with information about a Guest, or a Guest provides us with information about other attendees, in connection with an enquiry or Booking.

5.2 Steps we take

Where we collect personal information about an individual from someone else, we will take reasonable steps to ensure that the individual is, or has been, made aware of:

  1. the fact that we are collecting the information;
  2. the purpose for which we are collecting it;
  3. the intended recipients of the information;
  4. our name and address, and that the individual may access and request correction of the information;
  5. whether the collection is authorised or required by law and, if so, the particular law; and
  6. the main consequences (if any) for the individual if all or part of the information is not provided.

5.3 Exceptions

We do not need to take those steps where an exception under the Privacy Act 2020 applies, including where:

  1. the individual has authorised non-compliance;
  2. non-compliance would not prejudice the interests of the individual;
  3. non-compliance is necessary to avoid prejudice to the safety of any individual;
  4. the individual has already been made aware of the matters set out above;
  5. the information will not be used in a form in which the individual is identified; or
  6. the information is publicly available information.

5.4 Where you provide information about someone else

If you provide us with personal information about another person — such as an attendee, emergency contact, or additional Guest — you must ensure that person is made aware of the matters set out in this clause, or that an applicable exception applies.

6. How we use personal information

We may use personal information to:

  • provide and operate the ærspace platform;
  • create and manage accounts;
  • introduce Guests and Hosts;
  • facilitate bookings;
  • communicate about enquiries and bookings;
  • provide customer support;
  • improve our services;
  • maintain security;
  • prevent fraud or misuse;
  • comply with legal obligations; and
  • send relevant service communications.

7. Disclosure of information

7.1 Sharing information between Guests and Hosts

Because ærspace operates as an introduction platform, we may provide relevant information:

  1. from Guests to Hosts; and
  2. from Hosts to Guests,

where reasonably necessary to facilitate an enquiry, booking or communication. Examples include:

  • Guest name and contact details;
  • booking requirements;
  • venue information;
  • availability;
  • booking details.

7.2 Service providers

We may disclose information to trusted third-party service providers who assist us with:

  • website hosting;
  • technology services;
  • communications;
  • analytics;
  • security; and
  • administration.

Those providers must handle information appropriately.

7.3 Legal requirements

We may disclose information where required or authorised by law.

8. Payment information

Unless otherwise stated:

  • ærspace collects hire fees and bonds in a single upfront payment;
  • ærspace holds bonds as security deposits (not trust money) until they are refunded;
  • ærspace processes payments between Guests and Hosts.

Card payments are processed by our payment provider, Stripe. Full card numbers are handled by Stripe and are not stored by ærspace. Payment arrangements are directly between ærspace and Guests and ærspace and Hosts. If ærspace introduces payment functionality in the future, this Privacy Policy may be updated accordingly.

9. Storage and security

We take reasonable steps to protect personal information from:

  • loss;
  • misuse;
  • unauthorised access;
  • disclosure;
  • alteration; or
  • destruction.

Security measures may include:

  • access controls;
  • secure systems;
  • authentication processes; and
  • monitoring.

No online system can be guaranteed to be completely secure.
